Terms of Service

The agreement between Riselist and the brands and agencies that use our shortlists and outreach. Updated 2 November 2026.

These terms are an agreement between Riselist (operated by Samuel Aguda) ("Riselist", "we", "us") and the business that signs up for or uses our service ("you", the "Customer").

Please read them carefully. By creating an account, paying, or using the service, you agree to these terms. If you are signing up for a company, you confirm you have the authority to agree for that company.

The service is for businesses only (brands, agencies and their staff). It is not for personal or consumer use. You must be at least 18.

1. What we do

Riselist helps brands find TikTok creators to work with. Today we work with you by email: you send us a brief, and we send back a hand-checked shortlist or run outreach for you. The software features below (accounts, search tools, exports) describe the platform we are building; where a feature is not yet live, the equivalent is delivered by email. We give you:

We call all of this the "Service". The creator information inside it is the "Data".

2. We are not TikTok

Riselist is independent. We are not owned by, linked to, sponsored by, or approved by TikTok, ByteDance, or any of their companies. "TikTok" is their trademark, and we use the name only to describe where public information comes from.

Creators listed in the Service have not signed up to Riselist and have not agreed to work with you. Being listed does not mean a creator endorses Riselist or your brand.

3. Your account

4. Plans, payment and refunds

5. How you may use the Service and the Data

You may use the Service and the Data only to find, assess and contact creators for your own (or, if you are an agency, your named clients') influencer marketing campaigns.

5.1 Rules for contacting creators

When you contact creators, you must follow our Outreach Rules at https://getriselist.com/outreach-rules.html. They form part of these terms. In short:

When we send emails for you (Outreach Sprint and Managed Campaign), we send them in your name and on your instructions, we follow the Outreach Rules ourselves, and we count every email towards the limits in those rules. You remain responsible for the truth of the offer and for the campaign itself.

When you send emails yourself, you are the sender. You are responsible for making sure your outreach follows the laws that apply to you and to the creator — for example anti-spam and privacy laws such as US CAN-SPAM, EU and UK GDPR, UK PECR, Canada's CASL, and Nigeria's Data Protection Act 2023. If you are not sure, get advice.

5.2 Things you must not do

You must not:

  1. Harass or pressure creators — no threats, abuse, repeated messages, or contacting them on personal channels.
  2. Spam — no bulk, untargeted or automated mass emailing, and no sending above the volume limits in the Outreach Rules.
  3. Sell, resell, rent, share or give away the Data, exports, or access to the Service, unless we agree in writing. Agencies may share shortlists with the specific client the campaign is for, but not publish them or build a competing database.
  4. Scrape or copy the Service — no bots, crawlers, scripts, or bulk downloading beyond the normal export tools.
  5. Build a competing product, or use the Data to train AI models or build a creator database for others.
  6. Combine the Data with other data to identify or track creators' private lives — for example home addresses, family, or personal phone numbers.
  7. Use the Data for anything other than marketing partnerships — for example credit checks, hiring decisions, background checks, or surveillance.
  8. Target children. Do not use the Service to find or contact anyone you know or suspect is under 18, and do not run campaigns that break the rules on advertising to children.
  9. Mislead creators or the public — no fake offers, scams, or pretending to be another brand.
  10. Break the law or anyone's rights, including advertising rules (see section 5.3).
  11. Ignore opt-outs. If a creator asks to stop being contacted, or asks to be removed, you must stop and tell us at samuelaguda77@gmail.com within 2 business days so we can add them to the shared do-not-contact list.
  12. Try to break, overload, hack, or get around the security or limits of the Service.

5.3 Sponsored content and ad disclosure

If you pay a creator, give free products, or offer commission, the creator's posts are ads. You must make sure they are clearly labelled — for example with "#ad" or "Ad" at the start of the caption and in the video itself, and by using TikTok's own branded-content tool. Brands share responsibility with the creator for this under rules like the US FTC Endorsement Guides and the UK CAP Code. Riselist does not run or check your campaigns.

5.4 Creator removal requests

Creators can ask us to remove or correct their information. When we remove a creator, they may also disappear from your shortlists and exports. You must delete any copies of that creator's Data you have exported within 14 days of us telling you, unless you already have a direct working relationship with them.

6. About the Data — please read

7. Outreach email drafts and AI features

Some features use automated tools (including AI) to suggest emails or summaries. These drafts may contain mistakes. You must read and edit every draft before you send it. Once you send an email, it is your email and your responsibility.

8. Your content and your data

9. Our intellectual property

We (or our licensors) own the Service, our software, design, scores, scoring methods, the way the Data is collected and organised, and our brand. These terms give you a limited, non-exclusive, non-transferable right to use the Service while your account is active. We keep all other rights.

Creators own their own videos, names and content. Nothing in these terms gives you any right to reuse a creator's videos or likeness — you need the creator's own permission for that.

If you send us ideas or feedback, we may use them freely without paying you.

10. Service availability and changes

We work hard to keep the Service running, but we do not promise it will always be available or free of errors. We may change, add, or remove features. If we remove a major feature you pay for, we will tell you in advance and you may cancel.

11. Disclaimer

Apart from what these terms expressly say, the Service and the Data are provided "as is" and "as available". To the fullest extent the law allows, we make no other promises — including about accuracy, completeness, being up to date, fitness for a particular purpose, or results.

12. Limit of our liability

To the fullest extent the law allows:

Nothing in these terms limits liability that cannot legally be limited — for example for fraud, or for death or injury caused by negligence.

13. Your responsibility to us (indemnity)

You will cover our reasonable losses and costs (including legal fees) if someone — for example a creator, a regulator, or TikTok — makes a claim against us because of:

14. Suspension and ending the agreement

15. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria.

If there is a problem, please contact us first at samuelaguda77@gmail.com. We will both try in good faith to settle it within 30 days.

If we cannot settle it, the dispute will be decided by the courts of Lagos State, Nigeria.

This does not take away any rights you have under laws that cannot be overridden by contract, such as mandatory consumer or data protection laws in your country.
